Form 8809 Provides Extensions For Information Returns

Tax season is in full swing. The business tax returns deadline just passed, and more deadlines for information returns and personal tax returns are rapidly approaching. Information Returns Extension Form 8809 is the form used by businesses to receive an extension of  30 days to file their W-2s, ACA, 1099s, and information returns with the IRS. The Extension deadline for Form 8809 on IRS Forms W-2 and 1099-MISC (NEC only) is January 31st.

Extension request 8809 must be e-filed for IRS forms W-2G, 1094-C, 1095, 1097, 1098, 1099, 3921, 3922, and 8027 by March 31st.

For IRS Forms 1042-S and 5498, the due dates for Extension Form 8809 are March 15th and May 31st, respectively.

Note: The Extension Form 8809 only extends the amount of time you have to file your information returns, not the amount of time you have to pay your taxes. Any amount owed to the IRS must be paid in full by the original tax deadline.

Failure to file Extension Form 8809 or your information returns by the original tax deadline will result in fees and penalties from the IRS:

If your information is filed less than 30 days late you’ll be subject to a fee of $50, with a maximum penalty of $529,500 per year or $185,000 for small businesses.

If your information return is between 30 to 120 days late you’ll be subject to a $100 fee with a maximum penalty of 1,589,000 per year or $529,500 for small businesses.

If your return is more than 120 days late, or you failed to file at all you’ll be subject to a $260 fee with a maximum penalty of $3,178,500 per year, or $1,059,500 for small businesses.
