Today is the Deadline to File Form 8809 for IRS Information Returns

What is Form 8809?

Form 8809 is an IRS tax extension form that can be used by businesses to request an extension of time to file their information tax returns with the IRS. This extension is applicable to 1099, ACA 1095 Forms, and many other information tax returns.

Upon filing Form 8809, you can get up to 30 days of extension. This extension is automatic, meaning you don’t have to provide the IRS with any reason for needing an extension unless you are requesting an extension for Form 1099-NEC or W-2.

The deadline for W2 and 1099-NEC forms can be extended only under the following circumstances,

  • A catastrophic event in a federally declared disaster area made you unable to resume your business operations or made necessary records unavailable
  • Fire, casualty, or natural disaster affected your business operation
  • Death, serious illness, or unavoidable absence of the responsible individual.
  • Your business is in its first year of establishment.

Remember, Form 8809 must be filed on or before the original deadline in order for your extension request to be approved.

Avoid Late Filing Penalties with an Extension

If you fail to file your information returns and don’t apply for an extension within the deadline, you could potentially become subject to the following late filing penalties:

  • $50/return for returns delayed not more than 30 days after the deadline. The maximum penalty is $588,500 for large businesses and $206,000 for small businesses.
  • $110/return for returns that are delayed more than 31 days but not later than August 1. The maximum penalty is $1,766,000 for large businesses and $588,500 for small businesses.
  • $290/return for returns delayed past August 1. The maximum penalty is $3,532,500 for large businesses and $1,177,500 for small businesses.
